Child custody arrangements should be uniquely tailored to fit the needs of the family and their accustomed lifestyle. Preferably, both parents would agree to a child custody arrangement which would permit them to avoid having to appear in court - saving both parties attorney's fees and emotional distress. Most importantly, by agreeing, the parents are able to maintain total control over the terms of the custody arrangement as opposed to the Court. The parents are the ones in the best position to truly know "what is in the best interest" of their children - the legal standard at the heart of all. Agreed upon custody arrangements are filed with the Court and become formal court orders binding upon the parents, unless and until there is a modification of such a custody arrangement either by stipulation of the parents or by further Court order.

Parents can seek sole physical custody to one parent with visitation to the other or joint custody with varying degrees of time to each parent depending on their circumstances. If parents cannot agree to a custody arrangement, the Court will decide the custody arrangement for the minor(s).

Parents (or the Court if no agreement can be reached) must also decide whether decision making regarding material issues impacting the child(ren)’s health, education and welfare shall be joint or sole to one parent. This is called “legal custody” and the default preference of the Court is for joint decision making.

Child and Spousal Support Orders, Modifications, and Enforcement

A “modification” of a Court’s order concerning child custody, child support, or spousal support is not uncommon. Regardless of the language set forth in a Judgment or Court Order, most issued orders can be modified depending on a change in events or a change of an individual’s circumstances.
